"However, the applicant has demonstrated and proved that the effectiveness of magnetic resonance therapy of professionals is at least highly controversial. This is especially clear in the document issued by the Stiftung Warentest manual "The Other Medicine" (Annex K 9). The contribution of "magnetic therapy" is to Ergebnis, dass nach dem heutigen Stand der Erkenntnisse schwache Magnetfelder keinen Einfluss auf menschliches Gewebe haben und: "Die Studien zur therapeutischen Wirksamkeit konservativer Magnetfeldbehandlung kommen zu widersprüchlichen Ergebnissen. Unter den kontrollierten Untersuchungen sind diejenigen, die eine heilende Wirkung nicht belegen, jedoch weitaus in der Überzahl". Ferner hat die Klägerin durch Vorlage von Stellungnahmen des Prof. Dr. ... glaubhaft gemacht, dass es nicht gesicherter wissenschaftlicher Erkenntnis entspricht, dass die Magnetfeldtherapie die von der Beklagten in ihren Werbeaussagen behaupteten Wirkungen hat. So führt er in seinem Lehrbuch der Physikalischen Medizin und Rehabilitation aus, dass "bis heute trotz zahlreicher internationaler Efforts is unclear whether asset trigger static or low frequency magnetic fields in the adapted orders of magnitude at all biological effects of any kind "and points out that since 19.02.1992, the magnetic field therapy counted in principle to the non-established treatment methods and cash therefore no longer -/vertragsärztlichen care should be applied and billed. In his expert opinion for the District Court of Flensburg 17.08.2000 (K10) ... comes to the conclusion that the magnetic field therapy in medicine is not considered generally accepted physical therapy procedures and takes on the extensive report that was approved in 1996 by Prof. Dr. ... in einem Verfahren vor dem Sozialgericht Köln erstellt wurde und in dem ebenfalls festgestellt wurde, dass eine Wirksamkeit der Magnetfeldtherapie wissenschaftlich nicht belegt werden kann und dass sie bei den meisten von ihr beanspruchten Anwendungsgebieten keine Wirkung zeigt. Entsprechend skeptisch wird die Magnetfeldtherapie in einem Gutachten des Prof. Dr. ... für das Landgericht Stuttgart (K 13) beurteilt, der ebenfalls zu dem Ergebnis kommt, dass die Wirksamkeit des dort beworbenen Geräts nicht erwiesen sei."

"Soweit die Verfügungsbeklagte ihr Gerät "... nomil" zur Mauerentfeuchtung bewirbt, folgt die Irreführung bereits daraus, dass es der insoweit darlegungs- und beweispflichtigen Verfügungsbeklagten nicht gelungen ist, irgendeinen wissenschaftlichen Nachweis für die von ihr beworbene Wirkung des Gerätes glaubhaft zu machen. Insbesondere reicht der Vortrag in der Erwiderung vom 18. März 2009, die inkriminierten Werbeaussagen beruhten auf Erfahrungswerten der Verfügungsbeklagten und vielen ihrer Kunden, nicht aus. Dies gilt insbesondere auch für die Verwendung von Begriffen wie "überlichtschnelle Teilchen", die das Energiefeld des Hauses change to "intelligently". Such "superluminal particles" are not scientifically proven and borrowed more the para-science and the esoteric. In that regard, it is not on the plaintiff to prove the lack of effectiveness of the advertised product by the Defendant (see only Hefermehl / Köhler / Bornkamp, \u200b\u200bUWG, 26th edition, 2008, § 5 para 3:26 further notes).
